1

Introduction

These Terms & Conditions ("Terms") form a binding agreement between you ("you" or "your") and Mishra Aman & Company ("the Firm", "we", or "us"), a Chartered Accountant firm practising under applicable Indian law and providing professional services to clients in India and the United Arab Emirates.

By accessing or using mishraaman.com, you agree to these Terms in full. They apply to all visitors, enquirers, and clients regardless of the purpose of access. These Terms should be read alongside our Privacy Policy, which together form the complete agreement between you and the Firm for use of this website.

If you are acting on behalf of a business or organisation, you confirm that you have the authority to bind that entity, and all references to "you" apply equally to that entity.

2

Services Disclaimer

Content on this website — including service descriptions, articles, and FAQs — is for general information only. It does not constitute professional advice and does not create a client-adviser relationship. Professional services are provided exclusively under a formal engagement agreement, which governs the scope, fees, and deliverables for each matter.

No guarantee of outcomes

Tax computations, refund results, audit opinions, and assessment decisions are determined by statutory authorities — not the Firm. Outcomes depend directly on the accuracy and completeness of information provided by the client. We do not guarantee any specific financial result or regulatory outcome.

Tax laws and compliance requirements in India and the UAE change frequently. While we aim to keep information current, we cannot guarantee that every page reflects the latest regulatory position at the time of access. Always seek direct professional consultation before acting on anything published here. Nothing on this website constitutes legal advice.

3

User Responsibilities

By using this website or engaging our services, you accept the following responsibilities:

  • Accuracy of information. You are solely responsible for the accuracy and completeness of all information and documents you provide. The Firm is not liable for any consequence arising from errors or omissions in the data you supply.
  • Legal compliance. You remain responsible for your own compliance with all applicable laws — including the Indian Income Tax Act, GST legislation, Companies Act, UAE Federal Tax Laws, and FEMA regulations. Our guidance assists but does not replace your compliance obligations.
  • Lawful use. You must not use this website for any unlawful, fraudulent, or deceptive purpose, or in any way that violates applicable law.
  • No unauthorised access. Attempting to gain unauthorised access to any part of this website or its infrastructure is prohibited and may constitute a criminal offence under applicable law.
  • Timely cooperation. During any engagement, you agree to respond promptly and supply documents as requested. Delays attributable to the client may affect our ability to meet statutory or regulatory filing deadlines, and the Firm will not bear responsibility for such delays.

4

Intellectual Property

All content on this website — including text, service descriptions, guides, graphics, logos, and design elements — is the exclusive property of Mishra Aman & Company and is protected under the Copyright Act, 1957, and other applicable intellectual property laws.

You may view and print content for personal, non-commercial use only. You may not:

  • Reproduce, republish, or redistribute any content without prior written consent;
  • Modify, adapt, or create derivative works from any content on this website;
  • Use any content for commercial purposes without explicit written authorisation;
  • Remove or alter any copyright, trademark, or proprietary rights notice.

The firm name, logo, and all associated branding may not be used without written permission. To request permission, email [email protected].

5

Limitation of Liability

To the extent permitted by law, the Firm is not liable for any loss or damage arising from your use of this website or reliance on its content, including:

Indirect or consequential loss

Loss of profits, business, savings, or reputation arising from reliance on information published on this website.

Third-party decisions

Outcomes determined by a statutory authority, regulator, bank, or court — regardless of the advice or service provided by the Firm.

Inaccurate client information

Penalties, interest, or regulatory consequences resulting from incorrect or incomplete information provided by the client.

Website availability

Any loss caused by downtime, technical errors, or interruptions in the availability of this website.

Where a formal engagement exists, the Firm's liability for any claim is limited to the scope defined in that engagement agreement and, in any event, shall not exceed the fees paid for the specific service giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

7

Confidentiality

All financial and business information shared during a professional engagement is treated as strictly confidential, consistent with the professional ethics obligations of the Institute of Chartered Accountants of India (ICAI).

Client information will not be disclosed to any third party except:

  • Where required by law, court order, or the direction of a statutory or regulatory authority;
  • Where you have provided express written consent to share information with a named third party;
  • Where necessary to deliver the agreed service and the third party is subject to equivalent confidentiality obligations.

How we handle personal data submitted through this website is covered separately in our Privacy Policy.

8

Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in India, unless otherwise agreed in writing.

UAE Services — Additional Clause

For services governed by UAE law — including UAE VAT, Corporate Tax, and statutory audit — the relevant UAE laws apply to the substance of that engagement. Disputes arising specifically from UAE engagements may, by written mutual agreement, be referred to mediation or arbitration under a recognised UAE arbitral body. In the absence of such an agreement, Indian jurisdiction applies.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining Terms will continue in full force.

9

Modifications to These Terms

We may update these Terms at any time without prior notice. Changes take effect immediately upon publication on this page. The "Last updated" date above will reflect the most recent revision.

It is your responsibility to check these Terms periodically. Continued use of this website after any update is published constitutes acceptance of the revised Terms. If you do not agree with a change, please stop using this website and, if you have an active engagement, notify us in writing.

We also reserve the right to modify, suspend, or discontinue any part of this website at any time without liability.
